Transactional Real Estate: Mark Schwartz’s real estate practice encompasses preparation and negotiation of contracts for the purchase and sale of commercial real estate, condominiums and cooperatives; counseling on initial due diligence, attention to title, and all details through closing. On the leasing side, Mark drafts and negotiates commercial leases, lease extension and modification agreements, subordination and non-disturbance agreements; and ancillary agreements such as access agreements, construction contracts, easement agreements and surrender of premises agreements. Mark has negotiated with municipal authorities for industrial development agency financing and sale-leasebacks benefitting from payment-in-lieu-of-tax (PILOT) arrangements on behalf of owners and developers.

Mortgage Based Lending: On the lending side Mark structures, negotiates and implements documentation for a wide range of commercial real estate secured loans and restructurings; drafting and negotiating loan commitments, promissory notes, fee and leasehold mortgages, building loan contracts, commercial loan agreements, security agreements, pledge agreements, guarantees, assignment of leases and various subordination, indemnity and reserve agreements.

Tangential to Mark’s real estate practice, he also undertakes certain trust and estate work.
